Why we are active here

In the daily advisory work of mprofi AG, we regularly encounter the situation that a liquidity crisis becomes visible once the room for action has already narrowed. The underlying patterns would have been recognisable months earlier, but the tools to observe this systematically are missing. SME managing directors have neither the time nor the training for a weekly liquidity analysis, and fiduciaries often see their mandates only on a quarterly basis.

Konkurse Abwenden closes this gap. It is not a dramatic crisis tool, but a calm, continuous observation of the indicators which — in the Swiss SME context — reliably point to a developing imbalance: debtor days, creditor stretching, bank-line utilisation, tax arrears.

Swiss regulatory context

The formal basis of any restructuring in Switzerland is the Swiss Federal Debt Enforcement and Bankruptcy Act (SchKG). It governs, among other things, the composition moratorium (Art. 293 ff. SchKG), the provisional and definitive composition agreement and the conditions for a bankruptcy stay. Before these formal steps, there is a wide field of action in which managing directors can negotiate with their creditors, obtain waivers of claims or organise bridge financing.

Our product supports above all this wide, formally unregulated field. As soon as the transition into SchKG proceedings is imminent, specialised lawyers take over. Konkurse Abwenden then keeps documentation and communication structured, without interfering in legal representation.
